Terms of Service

Welcome to ShaderDeck. By accessing or using our website, APIs, embeds, plugins, integrations with external platforms such as Framer, Webflow, Wix, Figma, and Shopify, or any other features or services we offer (collectively, the "Service"), you agree to be bound by these Terms of Service ("Terms"). Please read them carefully.
1. Acceptance of Terms
By creating an account or using ShaderDeck in any way, you confirm that you are at least 13 years of age and that you accept and agree to these Terms. If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization to these Terms.
2. Description of Service
ShaderDeck provides a library of WebGL shader backgrounds, export tooling, APIs, embeds, and related features for use in web applications and design tools. We offer both free and paid subscription tiers with varying levels of access to shaders, features, export options, and support.
Beta and Experimental Features
We may release certain features or services as "beta," "preview," or "experimental." These features are provided as-is without warranty and may be changed, limited, or discontinued at any time without notice. Your use of beta features is at your own risk.
3. Accounts
You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You must notify us immediately of any unauthorized use. ShaderDeck is not liable for any loss resulting from unauthorized use of your account.
4. Subscriptions and Billing
Some features require a paid subscription. By subscribing, you authorize us to charge your payment method on a recurring basis until you cancel. Prices are listed on our Pricing page and may change with at least 30 days' advance notice. In the event of a failed payment, your access to paid features may be suspended until payment is resolved. Refunds are handled on a case-by-case basis — contact us within 7 days of a charge if you believe an error occurred.
5. License and Permitted Use
Subject to these Terms, ShaderDeck grants you a limited, non-exclusive, non-transferable license to use the shaders and assets provided through the Service in accordance with your subscription tier. The full and current list of features and export options available on each tier is maintained on our Pricing page. As a general guide:
- Free tier users receive a personal-use license for a limited set of basic shader presets. Use in commercial projects is not permitted under the Free tier.
- Plus tier users receive a commercial license with access to premium shader presets and select export options.
- Pro tier users receive a commercial license with access to all premium shader presets and all available export options.
Shaders and assets downloaded during an active subscription period may continue to be used in projects where the shader was already integrated prior to cancellation, but may not be incorporated into any new projects started after the subscription has lapsed, expired, or been cancelled. You may not resell, sublicense, or redistribute ShaderDeck shaders or assets as a standalone product (free or paid) or as part of a competing service.
6. Intellectual Property
All content, code, graphics, and materials made available through the Service are the property of ShaderDeck or its licensors and are protected by applicable intellectual property laws. Nothing in these Terms transfers any ownership of our intellectual property to you.
7. User Conduct
You agree not to:
- Use the Service for any unlawful purpose
- Attempt to reverse-engineer, decompile, or extract proprietary components of the Service
- Abuse, harass, or harm other users or ShaderDeck staff
- Use automated scripts or bots to scrape or bulk-download content
- Circumvent any access controls or subscription restrictions
- Use the Service in any manner that could damage, disable, overburden, or impair our infrastructure or interfere with any other party's use of the Service
8. Third-Party Platforms and Integrations
The Service supports export to and integration with third-party platforms including Framer, Webflow, Wix, Figma, Shopify, and others. ShaderDeck is not affiliated with these platforms and is not responsible for any changes, deprecations, or incompatibilities they introduce that affect the functionality of exported assets or integrations.
Third-party platforms are subject to their own terms of service and privacy policies. Your use of those platforms is governed by their terms, not ours. We make no warranty that the Service will remain compatible with any specific third-party platform.
9. Disclaimer of Warranties
The Service is provided "as is" and "as available" without warranties of any kind, express or implied. ShaderDeck does not warrant that the Service will be uninterrupted, error-free, or free of harmful components. We make no warranties regarding the fitness of the Service for any particular purpose, the accuracy of any content, or the continued availability of any feature or export option. Use of the Service is at your own risk.
10. Limitation of Liability
To the fullest extent permitted by law, ShaderDeck shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service, even if advised of the possibility of such damages. This includes, without limitation, damages resulting from loss of profits, data, goodwill, or business interruption, or from third-party platform changes that affect compatibility with your projects. Our total liability for any claim relating to the Service shall not exceed the amount you paid us in the three months preceding the claim.
11. Indemnification
You agree to indemnify and hold harmless ShaderDeck and its affiliates, officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorneys' fees, arising out of or in any way connected with your access to or use of the Service, your violation of these Terms, or your infringement of any intellectual property or other rights of any third party.
12. Service Modifications
ShaderDeck reserves the right to modify, suspend, limit, or discontinue any part of the Service at any time, including features, export options, integrations, API endpoints, and subscription tier contents. We will endeavor to provide reasonable advance notice of material changes that affect paid users, but are not obligated to do so. Continued use of the Service after any modification constitutes acceptance of the modified Service.
13. Force Majeure
ShaderDeck shall not be liable for any failure or delay in performance resulting from causes beyond our reasonable control, including but not limited to acts of God, natural disasters, pandemic, war, terrorism, riots, government action, internet or infrastructure outages, third-party service failures (including cloud providers and payment processors), or other events outside our reasonable control.
14. Termination
You may cancel your subscription at any time through your account settings; your access to the Service will continue until the end of your current billing period, after which it will cease. You may delete your account at any time through your account settings, which will immediately terminate your access to the Service and remove your account data in accordance with our Privacy Policy. We reserve the right to suspend or terminate your account at any time for violations of these Terms or for any other reason at our discretion, in which case your access to the Service ceases immediately. Regardless of the reason for termination, the restrictions on use of downloaded shaders and assets outlined in Section 5 continue to apply.
15. Changes to Terms
We may update these Terms from time to time. We will notify you of material changes via email or a notice on the Service. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
16. Governing Law
These Terms are governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict of law principles. Any disputes not subject to arbitration under Section 17 shall be resolved in the competent courts of Florida, and you consent to the exclusive jurisdiction of such courts.
17. Dispute Resolution and Arbitration
PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS, INCLUDING YOUR RIGHT TO FILE A LAWSUIT IN COURT.
You and ShaderDeck agree that any dispute, claim, or controversy arising out of or relating to these Terms or the use of the Service ("Dispute") shall be resolved exclusively by binding individual arbitration, except as set forth below. This agreement to arbitrate is intended to be broadly interpreted and applies to all Disputes regardless of the legal theory on which they are based.
Informal Resolution First
Before initiating arbitration, you agree to contact us at support@shaderdeck.com and give us 30 days to attempt to resolve the Dispute informally. If the Dispute is not resolved within that period, either party may initiate arbitration.
Arbitration Rules
Arbitration shall be administered by the American Arbitration Association ("AAA") under its Consumer Arbitration Rules, or such other arbitration provider as the parties may mutually agree. The arbitration will be conducted in English. The arbitrator's decision shall be final and binding and may be entered as a judgment in any court of competent jurisdiction.
Class Action Waiver
YOU AND SHADERDECK AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN AN INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, COLLECTIVE, OR REPRESENTATIVE PROCEEDING. The arbitrator may not consolidate more than one person's claims or preside over any form of class proceeding.
Exceptions
Either party may seek emergency injunctive or other equitable relief in a court of competent jurisdiction to prevent actual or threatened infringement, misappropriation, or violation of intellectual property rights. Small claims court actions that qualify under the applicable court's rules are also exempt from this arbitration agreement.
